General Terms and Conditions

1. Scope of Application

The following terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership with legal capacity who acts in the exercise of their commercial or self-employed professional activity when entering into a legal transaction.

2. Contracting Parties, Conclusion of Contract

The purchase contract is concluded with Philipp Khodaverdi, Coziness.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order, you will receive a confirmation by email.

3. Contract Language, Storage of Contract Text
The language available for the conclusion of the contract is English.

We do not store the contract text.

4. Delivery Conditions

In addition to the indicated product prices, shipping costs will be added. Further information on the amount of the shipping costs can be found in the offers.

We only deliver by shipping. Unfortunately, self-pickup of the goods is not possible.

We do not deliver to packing stations.

5. Payment

In our shop, the following payment methods are generally available to you:

Credit Card
By placing the order, you simultaneously transmit your credit card data to us.
After your legitimacy as the rightful cardholder has been confirmed, we will immediately request your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and your card is charged.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.
The payment transaction is carried out by PayPal immediately thereafter. You will receive further instructions during the ordering process.

Sofort by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. To be able to pay the invoice amount via Sofort, you must have an online banking account that has been activated for participation in Sofort and have the PIN/TAN procedure, legitimize yourself accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction is carried out by Sofort immediately thereafter, and your account is debited.

6. Retention of Title

The goods remain our property until full payment is made.

7. Transport Damages

If goods are delivered with obvious transport damage, please report such defects to the delivery personnel as soon as possible and contact us immediately. The failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.

8. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies.
For used goods, the following applies: if the defect occurs after one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year from delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The above limitations and shortened periods do not apply to claims based on damages caused by us, our legal representatives, or vicarious agents

  • in the event of injury to life, body, or health,
  • in the event of intentional or grossly negligent breach of duty and fraudulent intent,
  • in the event of a breach of material contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner regularly relies (cardinal obligations),
  • in the context of a guarantee promise, if agreed, or
  • to the extent that the scope of the Product Liability Act is opened.

9. Liability

We are always liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents

  • in the event of injury to life, body, or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of guarantees, if agreed, or
  • to the extent that the scope of the Product Liability Act is opened.

In the event of a breach of material contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner regularly relies, (cardinal obligations) due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the damage that was foreseeable at the time of conclusion of the contract and that typically must be expected to occur. In all other respects, claims for damages are excluded.

We are not obligated or willing to participate in a dispute settlement procedure before a consumer arbitration board.
